Acceptance of Terms

By accessing this website, submitting a booking request, signing a rental agreement, or renting equipment from Longhorn Equipment Rentals, LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions.

 

If you do not agree to these Terms, you must not use this website or our services.

Website Use

This website is provided for informational and booking purposes only. You agree not to:

  • Use the website for unlawful purposes

  • Attempt to gain unauthorized access to systems or data

  • Submit false or misleading information

  • Interfere with website functionality

 

We reserve the right to restrict or terminate access to our website at any time.

Rental Agreement Controls

All equipment rentals are governed by a separate written Rental Agreement. In the event of any conflict between these Terms & Conditions and the Rental

 

Agreement, the Rental Agreement shall control.

Eligibility to Rent

To rent equipment, you must:

  • Be at least 18 years of age

  • Provide valid government-issued identification

  • Provide valid payment information

  • Maintain valid automobile insurance sufficient to tow the rented equipment

 

We reserve the right to refuse service at our discretion.

Payments & Deposits

Full payment and any required security deposit must be received prior to delivery.

​

By submitting payment information, you authorize the Company to charge the payment method on file for:

  • Rental fees

  • Security deposits

  • Damage charges

  • Cleaning fees

  • Overweight violations

  • Late return fees

  • Contract violations

All fees are subject to the terms outlined in the Rental Agreement.

Delivery & Pickup

Delivery and pickup services are governed by our Delivery & Pickup Policy.

 

The customer is responsible for providing a safe and accessible location for trailer placement and assumes responsibility for risks associated with the selected placement area.

​

Limitation of Liability

To the fullest extent permitted by Texas law, Longhorn Equipment Rentals, LLC shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits or business interruption

  • Property damage resulting from improper loading, overloading, misuse, or unauthorized relocation

  • Towing-related incidents involving the customer’s vehicle

 

The customer assumes all risks associated with towing and using rented equipment.

Assumption of Risk

Use of dump trailers and towing equipment involves inherent risks, including but not limited to:

  • Vehicle damage

  • Property damage

  • Personal injury

  • Load shifting

  • Road hazards

​

By renting equipment, the customer voluntarily assumes all risks associated with use and towing.

​

Indemnification

You agree to indemnify and hold harmless Longhorn Equipment Rentals, LLC from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:

  • Your use or misuse of rented equipment

  • Violation of these Terms

  • Violation of applicable laws or regulations

  • Damage caused by overloading or improper securing of materials

 

No Warranty

All equipment is provided “as is” without warranties of any kind, either express or implied, except as required by law.

 

We make no guarantees regarding uninterrupted website availability.

Intellectual Property

All content on this website, including text, logos, images, and design elements, is the property of Longhorn Equipment Rentals, LLC and may not be copied, reproduced, or distributed without written permission.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas.

 

Any legal action arising from these Terms shall be filed in a court of competent jurisdiction located in Tarrant County, Texas.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Modifications

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of our website or services constitutes acceptance of any revised Terms.
